A Glad Scientist is a digital storefront operated by Dan Frederickson, a sole proprietor based in California. In these terms, "we," "us," and "A Glad Scientist" refer to that entity. "You" refers to anyone accessing the site or purchasing from it.
By using this site or purchasing from it, you agree to these terms.
What we sell
A Glad Scientist sells digital files — high-resolution images and related artwork — delivered as downloads after purchase.
License granted to you
When you purchase a file from us, we grant you a non-exclusive, non-transferable, worldwide license to use that file for personal, non-commercial purposes.
You may not:
- Resell, sublicense, or redistribute the file
- Use the file in commercial products, merchandise, or services
- Train machine learning models on the file
- Claim the file as your own work
- Remove or alter any embedded copyright or watermark information
We retain all copyright and intellectual property rights in the work. Your purchase grants a license, not ownership of the underlying work.
How purchases work
Payment processing is handled by Stripe, Inc. We don't receive or store your full payment card details. After your payment is successfully processed, you'll receive an email receipt and access to a time-limited download link valid for 24 hours.
If your download link expires before you've retrieved the file, the recovery page can issue a new link to the email address used at checkout. We retain records of completed purchases for the purposes of recovery, accounting, and legal compliance.
Pricing and availability
Prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors, modify the catalog, withdraw items, and refuse or cancel orders at our discretion, including after an order has been placed. If we cancel an order after payment, we will refund the full amount to the original payment method.
Refunds
Digital products are generally final — once a file has been downloaded, we can't take it back. That said, if something is wrong, reach out and we'll sort it out. Full details are on the Refunds page, which is incorporated into these terms by reference.
Accounts and access
The site does not require account creation. Access to a purchased file is granted via the email address used at checkout. You are responsible for the security of that email address and for keeping your purchase records.
Acceptable use
You agree not to:
- Use the site or its files for any unlawful purpose
- Attempt to access purchases or accounts that are not yours
- Scrape, mirror, frame, or systematically copy the site or its contents
- Reverse-engineer or interfere with the site's operation
- Impersonate A Glad Scientist or imply endorsement by us
- Upload malicious code or content
- Use the site in any way that could damage, disable, or impair it
We reserve the right to refuse service, terminate access, and pursue legal remedies for violations of these terms.
Intellectual property
All content on the site — including artwork, text, fonts, layouts, and the A Glad Scientist name and logo — is owned by us or licensed to us, and is protected by copyright, trademark, and other laws. Nothing in these terms transfers ownership of any intellectual property.
Third-party services
The site uses third-party services (Stripe, Vercel, Cloudflare, Resend, and others) to function. We are not responsible for the practices or policies of these services. Their terms and policies govern your interaction with them.
Disclaimers
The site and all files are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the site or any file will meet your requirements, that any defects will be corrected, or that the site will be free of viruses or harmful components.
Some jurisdictions don't allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
Limitation of liability
To the maximum extent permitted by law, in no event shall we or our service providers be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill, arising out of or related to your use of the site or any file purchased from it, regardless of the legal theory.
Our total aggregate liability for any claim arising out of or relating to these terms or the site shall not exceed the greater of (a) the total amount you have paid us in the twelve months preceding the event giving rise to the claim, or (b) $50 USD.
Some jurisdictions don't allow the limitation of liability for certain damages, so some of these limitations may not apply to you.
Indemnification
You agree to indemnify and hold us and our service providers harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the site, your violation of these terms, or your violation of any third party's rights.
Termination
We may suspend or terminate your access to the site at any time, with or without notice, for any reason, including violation of these terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
Changes to these terms
We may update these terms at any time. The "Last updated" date at the top reflects the current version. Material changes will be noted on the site. Continued use of the site after changes constitutes acceptance of the revised terms.
Governing law and dispute resolution
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these terms or the site shall be resolved exclusively in the state or federal courts located in Los Angeles County, California. You consent to the personal jurisdiction of those courts.
To the extent permitted by law, you and A Glad Scientist agree that any dispute will be brought in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
Severability
If any provision of these terms is found unenforceable, the remaining provisions remain in full force and effect.
Entire agreement
These terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and A Glad Scientist regarding the site and supersede any prior agreements.
